Ten-Year Policy France

It is not always easy for Belgian contractors and architects who carry out projects in France to insure themselves correctly. On the one hand, there is the complex legal framework of the "Loi Spinetta" and the "Code des Assurances". On the other hand, French insurance companies also set particularly high requirements, which makes it difficult for Belgian architects and contractors to take out insurance in France. Protect is the only Belgian insurer to intervene with the Ten-Year French policy, in accordance with French regulations.

1. Who is the policyholder and who is insured?

The Belgian (sub)contractor who performs works in France for which a 10-year liability applies.

2. What is insured?

Basic guarantees
The Ten-Year policy guarantees the statutory 10-year liability of the (sub)contractor for each project. The main guarantee covers the repair or replacement costs of the works of the insured contractor which fall under the insurance obligation cf. articles 1792 in 1792-2 of the “Code Civil”.

Additional guarantees
The policyholder may choose to insure the following additional guarantees:

  • the guarantee for the proper functioning of the technical equipment (Art. 1792-3 of the Civil Code), such as heating and sanitary installations, for a period of 2 years from the acceptance of the project damage to the existing property intangible consequential loss

3. What is the insured amount?

The policy guarantees the total of the repair costs. For buildings in non-residential construction, the guaranteed capital is equal to the construction cost.

4. How does the inspection work?

Depending on the nature and the size of the works an inspection will be required for the ten-year insurance, to be performed by an officially recognised external inspection agency. The cost of this is at the expense of the policyholder.

5. For which period are you insured?

The policy guarantees all claims for damages that are lodged within a period of ten years from the delivery of the works. The damages must relate to defects that are noticed after delivery.

6. What is the price?

The cost price depends on the nature and value of the work to be insured.
